1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and BuildTrail ("we," "us," or "our") regarding your use of BuildTrail's websites, applications, and related services (collectively, the "Service"). If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be able to form a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

• Upload, transmit, or store malware, unlawful content, or content that infringes intellectual property or privacy rights.
• Attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication measures without authorization.
• Interfere with other users' access, overload infrastructure, or automate access in a way that impairs the Service.

4. User content

You retain ownership of content you submit ("User Content"). You grant us a worldwide, non-exclusive license to host, store, reproduce, and display User Content solely to operate, improve, and promote the Service. You represent that you have the rights necessary to grant this license.

5. Subscriptions and fees

Paid features, if offered, are billed according to the plan you select. Unless stated otherwise, fees are non-refundable except as required by law or as described in our Returns & refunds policy. We may change prices with reasonable notice.

6. Intellectual property

The Service, including its design, branding, and underlying software, is owned by BuildTrail and its licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.

7. Third-party services

The Service may integrate with third-party tools or links. Those services are governed by their own terms; we are not responsible for third-party content or practices.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDTRAIL AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS.

10. Indemnity

You will defend and indemnify BuildTrail and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or if we discontinue the Service. Provisions that by their nature should survive will survive termination.

12. Changes

We may update these Terms from time to time. We will post the revised version and update the "Last updated" date. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which BuildTrail operates, without regard to conflict-of-law principles, except where prohibited by applicable consumer protection laws.
